Trust Administration vs. Probate in Utah

A properly funded trust avoids probate court in most cases, which can mean a more private asset distribution process for your family. Probate, by contrast, is a court-supervised process that validates a will, settles debts, and transfers assets. Straightforward Utah estates can move through probate in four to six months; complex ones take longer.

That said, having a trust doesn’t eliminate all post-death legal responsibility. If assets were never transferred into the trust during the settlor’s lifetime, such as real estate that remained titled in the decedent’s name, those assets may still require a probate proceeding to reach the intended beneficiaries. Utah offers simplified procedures for small estates with probate assets under $100,000 and no real property, but most families benefit from a legal review before assuming that shortcut applies.

Trusts also tend to reduce family conflict. Because trust distributions aren’t processed through a public court proceeding, the avenue for disgruntled heirs to contest asset transfers is often narrower than in probate. When disputes do arise, Sandberg, Stettler, & White handles contested trust matters as well.
